Replacing the penalty of imprisonment with a fine.
By a judgment of the Court of Appeal in Warsaw, a sentence of imprisonment imposed on our Client with a conditional suspension for a trial period of 1 year has been replaced by fine.
In this case, our Client was accused of forging a document (Article 270 § 1 of the Penal Code in conjunction with Article 310 § 1 and § 2 of the Penal Code) in order to achieve financial gain (Article 286 § 1 of the Penal Code) and convicted in the first instance based on Article 286 § 3 of the Penal Code to a six-month imprisonment suspended for a probationary period of 1 year and to a fine.
As a result of the appeal lodged by the defenders, the court of second instance accepted the position of defense recognizing the penalty imposed by the court of first instance as disproportionate to the act committed, as a result of which it changed it into a fine.
